Terms of Service for Bells Hire
- Introduction This Equipment Hire Agreement (“Agreement”) is made between Bells Hire (“Hirer”) and You (“Customer”). By hiring the equipment, the Customer agrees to the terms and conditions set forth herein regarding the hire of equipment.
- Equipment Description The Hirer agrees to rent the following equipment to the Customer:
- Rental Period The rental period shall commence on the day the equipment is picked up by the Customer and shall conclude upon its return to Bells Hire's business address. The Customer may request an extension of the rental period, subject to availability and written approval from the Hirer
- Definition of Day Hire A "day hire" is defined as a rental period of up to 11 hours (7am- 6pm) within a single calendar day. The Customer may use the equipment during this time frame. Any use beyond the 10-hour limit will incur additional charges at the prevailing hourly rate of [specify rate, if applicable].
- Responsibilities of the Hirer The Customer agrees to:
- Use the equipment only for its intended purpose and in accordance with all safety regulations.
- Maintain the equipment in good working order and report any malfunctions or damage to the Hirer immediately.
- Ensure that all operators of the equipment are adequately informed about its use and safety guidelines. It is Customers responsibility to read specific guidelines for the use of the equipment, including safety procedures and maintenance expectations, to reduce the risk of misuse.
- Refill the fuel before returning the equipment; if not, the cost of refuelling will be deducted from the security deposit.
- Towing of Machinery The Customer is responsible for towing the equipment safely and in compliance with all applicable laws and regulations. The Customer must ensure that they have the appropriate towing vehicle and equipment, and that all necessary permits are obtained prior to towing. The Hirer shall not be liable for any damages or liabilities incurred during the towing of the equipment.
- Delivery and Pickup Responsibilities The Customer is responsible for ensuring they can meet the scheduled pickup and return times for the equipment. If the Customer is unable to make the designated pickup time, they must notify Bells Hire as soon as possible. The Hirer reserves the right to impose a late fee for any equipment not returned on time. If the equipment is not returned on the scheduled day and is returned the following day, the Customer will incur a full day’s hire fee.
- Payment Terms All rental fees are subject to the prices listed on the Bells Hire website at the time of rental. The Customer acknowledges that these prices may vary and agrees to pay the applicable rate as indicated during the rental process. Any changes in pricing will be communicated to the Customer before confirmation of the rental. A security deposit of [Deposit Amount] is required at the time of rental. This deposit will be refunded upon the return of the equipment in satisfactory condition, subject to inspection. If any damages or issues are found, the cost of repairs will be deducted from the security deposit.
- Security Deposit Refund The security deposit of $200 will be refunded to the Customer within 3-5 business days following the return of the equipment, provided that the equipment is returned in satisfactory condition, subject to inspection. If any damages or issues are found, the cost of repairs or replacement will be deducted from the deposit before the remaining balance is refunded. The Customer will be notified of any deductions and provided with an itemized invoice if applicable.
- Liability and Indemnification The Customer assumes all risks associated with the use of the equipment. The Customer agrees to indemnify and hold harmless the Hirer from any claims, damages, or losses arising from the Customer's use of the equipment, including but not limited to personal injury, property damage, or accidents.
- Damage and Loss in the event of damage to or loss of the equipment, the Customer shall be responsible for the cost of repairs or replacement. The security deposit may be forfeited to cover these costs. The Hirer will assess damages and provide the Customer with an itemized invoice. The Hirer will have 7 days from the date of return to inspect the equipment and notify the Customer of any damages or issues.
- Insurance The Hirer maintains insurance coverage for the equipment during the rental period, including liability and theft insurance. The Customer is responsible for any damage or loss not covered by this insurance and may be required to pay for repairs or replacement costs. The Hirer will provide the Customer with details of the insurance coverage upon request.
- Cancellation and Termination The Customer may cancel the rental agreement by notifying Bells Hire. If cancellation occurs within 24 hours of the rental start time, the Customer will forfeit 50% of the security deposit. The Hirer reserves the right to terminate the rental agreement at any time at their discretion, providing notice to the Customer.
- Governing Law This Agreement shall be governed by and construed in accordance with the laws of New south Wales Any disputes arising under this Agreement shall be resolved in the courts of Australia.
- Collection of Personal Data By using our services and providing personal information, the Customer agrees to the collection, use, and processing of their personal data in accordance with our Privacy Policy. This includes information necessary for processing orders, communications, and fulfilling contractual obligations. The Customer has the right to access, update, or request deletion of their personal data as permitted by law.
- Payment Processing All payments made through this service are processed by third-party payment processors (e.g., PayPal, Stripe, Square). By providing payment information, the Customer acknowledges and agrees that the Hirer is not responsible for the security or privacy practices of these third-party processors. The Customer is encouraged to review the privacy policies and terms of service of any payment processor used. The Hirer shall not be liable for any errors or issues arising from the payment processing.
- Dispute Resolution In the event of any dispute arising out of or relating to this Agreement, the parties agree to attempt to resolve the dispute amicably through good faith negotiations. If the dispute cannot be resolved within [30 days], the parties agree to submit the dispute to mediation before pursuing any legal action. If mediation is unsuccessful, the parties may then proceed to arbitration in accordance with the rules of relevant arbitration body, decided by Bells hire and the decision of the arbitrator shall be final and binding.
Acceptance of Terms
By ticking "Yes" and proceeding with the order online, the Customer agrees to the Terms of Service outlined in this Agreement.
Signature and Date While no physical signature is required for online transactions, by completing the order, the Customer acknowledges their acceptance of these terms and conditions.
- Governing and Amendments State that any amendments to the Terms of Service must be in writing and signed by both parties, ensuring clarity and legal standing.
- Severability Include a clause stating that if any provision of the agreement is found to be invalid or unenforceable, the remaining provisions will still be in effect.
- Third-Party Services Bells Hire use third-party services for payment processors and adhere to the privacy and policies.
- User Responsibilities The hiring Customer is responsible for ensuring that they are legally able to hire and operate the equipment, including having any necessary licenses.
Equipment Use Guidelines Customer to be responsible for watching and reading all safety instructions provided on website.
